Please read the following Terms of Use ("Terms") carefully before using this App/Site so that you are aware of your legal rights and obligations concerning androgamesinfotech.in ("ANDRO GAMES INFOTECH PVT. LTD.", "we", "our" or "us").
1.1. The IKL Trivia is an associated brand of ANDRO GAMES INFOTECH which is officially regulated by the ANDRO GAMES INFOTECH PVT. LTD.
1.2. The Site (i) provides information about leading worldwide official SkillS (each a SkillS") that are provided by independent the Online Skill Gaming Software"), (ii) enables registered Site users ("Users") to purchase chips for specific and separate Skill (each a "Skill game") using the Site's messenger services ("the Messenger Service"); and (iii) offers Services (defined below) to Users, all subject to and in accordance with these Terms. A complete list of the Skills in connection therewith we offer our Messenger services, and the schedule for each Skill game is displayed on the App/Site
2. Consent, Modification, and Language.
2.1. By accessing or using the App/Site, including without limitation viewing the Content (as defined below), you signify your assent to (i) these Terms; (ii) our Privacy Policy (defined below); and (iii) any other legal notices published by us on the Site (collectively the "Site Terms"). The Site Terms apply to all visitors and users of the App/Site. If you do not agree to the Site Terms, then please do not access or use the Site.
2.2. We reserve the right, at our discretion, to change the Site Terms at any time; if we do so we will notify in advance of such changes. The changes will come into effect following your confirmation of acceptance thereof.
2.3. If you are reading a translation of any Site Terms (including any Terms concerning bonuses) in a language other than English, you acknowledge and agree that (i) the English version is the official version and is the legal basis of the relationship between you and ANDRO GAMES INFOTECH PVT. LTD.; (ii) the non-English versions reflect the same principles as the English version however they are only provided for information purposes and your convenience; (iii) the non-English versions are not valid as an agreement between you and ANDRO GAMES INFOTECH PVT. LTD.; and (iv) in the event of any inconsistency between the English and a non-English version of any Site Terms, the English version will prevail and govern.
3. Ability to Accept Terms and Legality of Use.
3.1. The App/Site is not intended for individuals under the age of eighteen (18) (or the applicable age in the relevant country). Therefore, if you are under 18 years (or such applicable age), you are prohibited from registering an Account (defined below) and using the Services (defined below). If it comes to our attention through reliable means that a User is under the age of 18 years (or such applicable age) we may, to the extent applicable, cancel that User's Account and/or access to the App/Site. Any funds deposited or any winnings of such prohibited User will be forfeited to the Authority.
3.2. It is your responsibility to determine that your access and use of the Site and the Services is legal and permissible pursuant to all applicable laws and regulations.
4. App/Site Access and Use.
We hereby grant you permission to access and use the App/Site, provided that you comply with these Terms and applicable law and do not: (i) copy, distribute or modify any part of the App/Site without our prior written authorization; (ii) use, modify, create derivative works of, transfer (by sale, resale, license, sublicense, download or otherwise), reproduce, distribute, display or disclose Content, except as expressly authorized herein; (iii) disrupt servers or networks connected to the App/Site; (iv) use or launch any automated system (including without limitation, "robots" and "spiders") to access and/or use the App/Site; (v) use the communications systems provided by the App/Site to send unsolicited or unauthorized commercial communications; (vi) use the App/Site for fraudulent or deceptive purposes; and/or (vii) circumvent, disable or otherwise interfere with security-related features of the App/Site or features that prevent or restrict use or copying of any Content or that enforce limitations on use of the App/Site. We reserve all rights not expressly granted in and to the App/Site.
5. Services.
Subject to applicable registration requirements, and your compliance with these Terms, we offer certain services in connection with the App/Site ("Services"), including, without limitation: the chips to play in the game.
6. Account.
6.1. General. In order to use some of the Services, it is necessary to first create an account (an "Account") and submit certain mandatory information to us in connection with your Account. You reserve the right to decide whether to submit any information to us, however, if you choose not to submit mandatory information you may be unable to register an Account and use and participate in certain Services. You may only register one Account for your personal use. You agree not to create an Account for anyone else or use the Account of another. When creating your Account, you must provide accurate and complete information, including full name, confirmation of legal age (if necessary as per the norms applicable by the government), contact e-mail or personal telephone number, and must thereafter keep such details up-to-date. ANDRO GAMES INFOTECH PVT. LTD. will store such details in accordance with the Data Protection Act ( Acc. To the Laws) and the regulations issued thereunder as may be amended from time to time. By providing these data you grant ANDRO GAMES INFOTECH PVT. LTD. permission to verify the data provided, including the verification of your age, directly through ANDRO GAMES INFOTECH PVT. LTD. or through specialized third-party providers. You are solely responsible for the activity that occurs in your Account, and you must keep your Account password secure. ANDRO GAMES INFOTECH PVT. LTD. will treat with care the information you entrust to it, in accordance with its privacy policy. You must notify ANDRO GAMES INFOTECH PVT. LTD. immediately of any breach of security or unauthorized use of your Account. You can stop using and may delete, your Account at any time by using the tools that are available on the App/Site ("App/Site Tools"). It is prohibited for users to sell, transfer and/or acquire Accounts to or from other Users or to transfer funds between Accounts.
6.2. Account Restrictions. If you are an (i) employee, director, officer, or Agent (defined below) of the ANDRO GAMES INFOTECH, or (ii) entity or person that is connected with the management or operation of an ANDRO GAMES INFOTECH, including each ANDRO GAMES INFOTECH PVT. LTD. Operator and its employees; or (iii) a spouse, de facto partner, parent, sibling, child or close family member of any of the persons mentioned in (i) and (ii) above, or (iv) located in the USA, UK, Israel, Turkey or any country which prohibits the provision of services such as the Services, then you are prohibited from registering an Account and participating in any Services. "Agent" means any third party service provider (and its employees) that we engage to perform Site management tasks on our behalf.
6.3. We reserve the right to refuse to create an account or to close an Account, at our sole discretion, save only that in the event of the closure of an Account, we will honour any already-existing obligations we may have to the User thereof.
6.4. You may close your Account at any time by writing to us at support@ikltrivia.com (PLEASE NOTE THAT WE WILL TAKE THE NECESSARY ACTIONS ONLY AFTER DUE VERIFICATION OF YOUR REQUEST)
6.5. We may apply an administrative fee (if necessary) on your Account if your Account has been inactive for a consecutive period of at least three (03) months ("Inactive Account"). An Account is deemed inactive when during the mentioned period there has not been recorded on the Account any login and/or log out without the requirement for any financial transaction.
6.6. We shall notify you by means of an email sent to the email address listed in your Account (such notice will be entitled, "Inactive Account Notification") that your Account is about to become an Inactive Account. The Inactive Account Notification will be sent to you up to one month prior to your account becoming inactive.
6.7. When an Account becomes inactive, we will deduct an administrative monthly fee from your Account if your Account is in credit.
6.8. You may be entitled to a refund of the fees charged in accordance with the MGA Directive 1 of 2011 Inactive Accounts Directive, as may be amended from time to time.
6.9. If your Account is considered a DORMANT ACCOUNT, i.e. no transaction has been recorded on the Account for a period of six (06) months or longer, we will notify you by means of an email to the email address listed in your Account (such notice will be entitled, "Dormant Account Notification").
6.10. If you do not take any action on your Account or contact us within seven (7) days of such email notification, all funds therein will be removed from your Account and either (i) transferred to you or, (ii) if we have been unable to contact you and/or if you cannot be satisfactorily located, transferred to the Authority.
6.11. Following the transfer of funds as described we shall close your Account.
7. Skill Quiz.
Each game is performed by the ANDRO GAMES INFOTECH PVT. LTD. Your participation in each quiz game is subject to the terms and conditions of the related ANDRO GAMES INFOTECH PVT. LTD. ("ANDRO GAMES INFOTECH PVT. LTD. Operator Rules"), which you agree to independently review and comply with.
8. The Quiz and Win Service.
8.1. General. We (i) make certain tools available on the App/Site so that Users can complete and submit online orders in connection with the Messenger Services offered by us with respect to ANDRO GAMES INFOTECH PVT. LTD. ("Orders");
8.2. Participation in the game. In order to participate in the game you must (i) have registered a valid, and maintain an active, Account; and (ii) comply with these Terms. A user satisfying these terms and lawfully purchasing ANDRO GAMES INFOTECH PVT. LTD. ( IKL Trivia ) chips through our Services accordingly shall be the owner of the purchased ANDRO GAMES INFOTECH PVT. LTD. ( IKL Trivia ) chips at any stage from the purchase of the ANDRO GAMES INFOTECH PVT. LTD. ( IKL Trivia ) chips on the Users behalf.
8.3. Cut-off Time. We stop to accept the submission of Skill a certain number of minutes before the performance of the related Skill by its ANDRO GAMES INFOTECH PVT. LTD. Operator ("Cut-Off Time"). We display on the App/Site the amount of time that is remaining until the Cut-Off Time for each game on the App/Site. We retain the right in our sole discretion to determine the length of the Cut-Off Time. Please be aware that once the Cut-Off Time for a particular Skill has expired, you will no longer be able to submit your Quiz for it.
9. Performance of Right Answer and Results.
9.1. Following each game, ANDRO GAMES INFOTECH PVT. LTD. will declare the related results entitled to earn ANDRO GAMES INFOTECH PVT. LTD.( IKL Trivia) chips to be paid by the ANDRO GAMES INFOTECH PVT. LTD. ("Prizes"). The number of Winning token that you need to obtain to be entitled to Winnings in connection with a game, as well as the amount of a Prize, is determined solely by the ANDRO GAMES INFOTECH PVT. LTD. Prizes.
9.2. You acknowledge and agree that (i) our designation of ANDRO GAMES INFOTECH PVT. LTD. is based on our sole judgment and methodology; (ii) our designation of Skill does not provide any opinion, and should not be taken to constitute any advice, about which ANDRO GAMES INFOTECH PVT. LTD. The skill you should participate in or whether you have an increased chance of success if you participate in ANDRO GAMES INFOTECH PVT. LTD. within a particular category; and (iii) ANDRO GAMES INFOTECH PVT. LTD. that is displayed at any given time in a Category on the App/Site is subject to change.
10. The Subscription Service.
10.1. General. The App/Site enables you to automatically participate, by means of our Messenger/App Services, in a specific ANDRO GAMES INFOTECH PVT. LTD. or a specific Category periodically (the "Subscription Service").
10.2. You may choose to simultaneously join an unlimited number of Skills (for different Skill or different Categories).
10.3. Term of Participation. You agree that your subscription (if applicable), and related payment obligations, will remain active until you use the App/Site Tools to suspend or deactivate your participation in the Subscription Service (if applicable), which you may do at any time (you may also use the Site Tools to reactivate your participation in the Subscription Service).
11. Payments.
(a) For such time as you are participating in the IKL Trivia, you will be debited ANDRO GAMES INFOTECH PVT. LTD. chips for each match that you play. (b) We Endeavour to purchase on the user's behalf each ANDRO GAMES INFOTECH PVT. LTD. chips as soon as the App/Site begins to accept Orders, and therefore you acknowledge that clicking on the “PLAY NOW” button will be considered your acceptance to deduct the match fee from your IKL wallet. In case you decide to suspend or deactivate your participation in the match afterwards, you accept that there will be no refund provided for the chips you have paid for the match. (c) You acknowledge that the Order Price for each Skill Draw may be subject to change for a number of reasons including, without limitation: (i) since the amounts that are displayed on the App/Site are based on your Designated Currency, the Order Prices are subject to daily currency conversion variations; (ii) the ANDRO GAMES INFOTECH PVT. LTD. may change the price that it charges for its Skill; (iii) since the Order Price may differ between various Skill, the Order Price for each Category may be different depending on which Skill is designated in that Category, or (iv) our service fees may change. (d) If you are participating in the Category Subscription Service (if applicable), then you may use the App/Site Tools to define (and subsequently adjust) a maximum price that you are willing to pay for any Order in connection with a specific Skill ("Price Limit the Skill). (e) PLEASE NOTE THAT YOU CAN SUBMIT THE RESPONSE TO EACH QUESTION ONLY ONCE AND BEFORE THE CLOSE TIME OF THE RESPECTIVE MATCH.
12. Adequate Funds.
You agree that we may automatically debit your Account in connection with your participation in the SubscriptionService (if applicable). If your Account does not contain adequate funds to pay for your participation in the Subscription Service (if applicable) then (i) we will charge your payment method (for example, the credit card that you have designated in your Account), and you hereby authorize us to do so; or (ii) we will not purchase on your behalf your Skill, in which event we will send an email to your designated email address notifying you that the transaction was not carried out due to insufficient funds.
13. Alert Service.
General. We offer certain alert services in connection with the App/Site whereby we provide Users with the opportunity to receive updates and alerts about ANDRO GAMES INFOTECH PVT. LTD., and the results of Skill (collectively, the "Alert Service"). The Alert Service may provide Users with the opportunity to choose whether to receive certain notifications by email ("Email Alerts") or SMS ("SMS Alerts"). If you choose to use the Alert Service, you may stop using it at any time by using the App/Site Tools or by sending us an opt-out request in accordance with our Privacy Policy. Please note that in addition to the Alert Service, we may anyway send you email notifications of Prizes as well as certain email or SMS advertisements, all in accordance with our Privacy Policy. To further promote responsible gaming, the Alert Service, email notifications or SMS advertisements will not be provided or sent to Self-excluded players or players that have reached their deposit limit.
14. Valid Email Address and Mobile Phone Number.
In order to use the Alert Service you must (i) have registered a valid, and maintain an active, Account; (ii) comply with these Terms; and (iii) if you wish to receive Email Alerts and/or SMS Alerts, maintain (as applicable) an active external email account ("Email Address") and/or mobile phone number ("Mobile Phone Number"). You may elect to use any part of the Alert Service by using the App/Site Tools to provide us with your Email Address and/or Mobile Phone Number and to designate information about Skill, or the Services that you would like to receive (collectively, "Notifications"). You agree a) that, depending on your designated method for receiving Notifications, we will send you Notifications to your Email Address and/or Mobile Phone Number; (b) to only provide accurate and current contact details for yourself, and to update your Email Address and/or Mobile Phone Number by using the App/Site Tools if either of them changes; and (c) that you will continue to receive Notifications from us until you use the App/Site Tools to suspend your participation in the Alert Service, or change the Notifications that you wish to receive, both of which you may do at any time.
15. Costs.
We do not currently charge for using our Alert Service. However, some third-party service providers charge a fee for you to receive SMS messages. If you choose to receive SMS Alerts (or otherwise choose to receive an advertising-related SMS from us), you acknowledge and agree that you may be charged your telecommunications carrier's or internet provider's messaging, data, internet access and other rates and fees for receiving the SMS.
16. Promotions.
To the extent that we offer certain promotions on the App/Site, you agree that your participation in said promotions is subject to these Terms. Details of our then-current promotions are displayed on the App/Site, as updated from time to time.
17. Aborted Orders and Termination of Orders; Errors.
17.1. In the event that the processing of an Order, once it has been Placed, is interrupted by a system failure of any nature and is not capable of completion, the amount of the Order will be refunded to your account.
17.2. We reserve the right to terminate Placed Orders without prior notice, whenever we deem this necessary due to software or other errors.
17.3. In the event that any information is incorrectly published on the App/Site, we will take action in order to rectify and amend the data in our system to reflect the correct information. Any winnings which are affected by the publishing of incorrect information will also be accordingly amended.
18. Payments by You to ANDRO GAMES INFOTECH PVT. LTD.; Deposits.
18.1. Orders. You acknowledge and agree that if (i) you choose to make a transaction on the App/Site (for example, by paying the Order Price) with your credit card; or (ii) there are insufficient funds in your Account to pay for a transaction that you have entered into, then ANDRO GAMES INFOTECH PVT. LTD. may charge that credit card or the credit card that you designate in your Account, and you hereby authorize the charging of that credit card (or any replacement card).
18.2. Subscription Service (if applicable). If you choose to use the Subscription Service to submit Orders repeatedly, we may collect the Order Prices through a recurring payment using your designated payment method (including by credit card). In connection thereto, ANDRO GAMES INFOTECH PVT. LTD. may submit period charges without further authorization from you, and such authorization shall remain effective until cancelled by you.
18.3. Restrictions and Acknowledgements. You agree: (i) to only provide valid and current credit card/post-paid instruments and billing information for yourself; (ii) that we may use the tools, software or services of third-party service providers to process transactions on our behalf; (iii) that you shall be liable for any card issuer processing fees in connection with payments and recurring payments; (iv) except as expressly set forth herein, all purchases are final and non-cancellable or non-refundable; (v) if payment is not received by us for any reason from your card issuer, you agree to promptly pay all amounts due to us upon demand and, if applicable ANDRO GAMES INFOTECH PVT. LTD. may charge a reasonable rejected payment fee, and (vi) any failure or inability by ANDRO GAMES INFOTECH PVT. LTD. to process any payment hereunder does not relieve you from your payment obligations.
18.4. In order to deposit funds in your Account, you can utilize one of the available deposit methods. Information on the methods available for deposits, including deposit limits, processing times and available currencies can be found in the Banking section of the App/Site As soon as you have registered your account, you can carry out an online deposit by clicking the "ADD" button and following the directions, ANDRO GAMES INFOTECH PVT. LTD. does not charge you a handling fee when you make a deposit.
18.5. We reserve the right to impose certain conditions on the use of particular payment methods and to change the payment methods available without giving notice. We do not guarantee that all methods of payment are available at all times.
18.6. We reserve the right to use additional procedures and means to verify your identity and carry out a "Know Your Client" ("KYC") procedure when you deposit funds in your Account.
19. Refund Policy.
19.1. Except as expressly stated in these Terms, you acknowledge and agree that any Order Prices and fees and/or payments paid by you to ANDRO GAMES INFOTECH PVT. LTD. in connection with your use of the App/Site and any Services are non-refundable.
19.2. If you reasonably believe that you have been wrongfully charged an amount by us you may notify us and request a refund. The tools within your Account should provide you with the means to do so, and in any event, you may contact us via our Support Service. Please be aware that we will not consider any such refund request unless you include full details of the disputed transaction, including the relevant dates, payment details, and a short explanation as to why the amount is disputed. If we, in our sole discretion, find that an amount has been wrongfully charged we will, as your sole remedy, refund you that amount.
20. The Transfer of Amounts to You and Your Use of Such Amounts.
20.1. General. During your use of the App/Site and Services, the following types of money or credit may be transferred to you or your Account: (i) Prizes; (ii) the cash value of money that you deposit into your Account for your use on the App/Site ("Deposits"); and/or (iii) Bonuses. Prizes and Deposits are collectively referred to herein as "Real Money". Bonuses are credited to your Account and collectively referred to herein as "Bonus Money". Your entitlement to any Real Money and/or Bonus Money is subject to and in accordance with these Terms. Bonus Money deposited into customers accounts will be valid for six (6) months from the date of deposit. At the end of this period, the Bonus Money will be automatically removed from the customer’s account.
20.2. Use of Real Money. Real Money is transferred to your Account and may be used in connection with your future transactions on the App/Site (for example Place Orders). You may withdraw any unused Real Money at any time.
20.3. Use of Bonus Money. Bonus Money is credited to your Account and may be used solely in connection with your future transactions on the App/Site (for example to place Orders). You may not withdraw the cash or monetary value of unused Bonus Money from your Account. Bonus Money deposited into customers accounts will be valid for six (6) months from the date of deposit. At the end of this period, the Bonus Money will be removed from the customer account without any prior email notification.
20.4. Order of Use and Sufficient Funds. If you Place an Order via the App/Site, then we will first debit any available Bonus Money that you have in your Account. If there is insufficient Bonus Money to pay for your transaction, we will debit any Real Money that you have in your Account. Please be aware that if your Account does not contain sufficient Bonus Money or Real Money to pay for your transaction, then we will charge the payment method that you have designated in your Account (for example, your credit card), and you hereby authorize us to do so.
20.5. Withdrawals from your Account. You may use the App/Site Tools to withdraw the available Real Money in your Account during redeemed your ANDRO GAMES INFOTECH PVT. LTD. chips, or any part thereof, by selecting your preferred withdrawal method. In order to withdraw certain amounts, you may first be required to provide us with specific information that will be used to confirm your identification and/or verify your credit card/post-paid instruments or another payment method third-party (will require verification of identity by way of a government-issued photo ID and proof of address no more than three months old). Additional information regarding the withdrawal of Real Money is displayed on the App/Site. Please note that if we provide you with any Bonus chips then it is solely for you to use in connection with the App/Site and it cannot be withdrawn from your account. Withdrawals will be remitted to the same account from where the funds paid into the User's Account originated, except in exceptional instances. To the extent that any User wishes to withdraw funds from a dormant, blocked, closed or excluded Account, they should contact the help desk.
20.6. Restrictions on Withdrawals from your Account. At least one game must be played before you are permitted to withdraw funds that you deposited in your account, but have not been used for playing.
20.7. For the avoidance of doubt, ANDRO GAMES INFOTECH PVT. LTD. is not, nor should be treated as a financial institution. No interest will be paid on any amounts deposited with or otherwise held by ANDRO GAMES INFOTECH.
20.8. The personal data of a User's Account and of the holder of the bank account (or any other payment method) to which it is requested that any Withdrawal be paid must correspond. We may perform a KYC procedure through which we will verify the validity of a User's personal details submitted prior to permitting any Withdrawal.
20.9. Information on withdrawal methods including settlement times and applicable fees can be found in the Banking section of the App/Site.
20.10. Taxes and Reporting. You shall be solely and wholly responsible for the reporting and payment of any and all taxes and charges arising from or imposed on amounts paid or transferred to you by the App/Site under these Terms. You acknowledge and agree that the ANDRO GAMES INFOTECH PVT. LTD. might retain a portion of your Prize and forward it to the appropriate taxing authority on your behalf.
20.11. Currency. To the extent that we credit or transfer you any amounts under these Terms, we will do so in the same currency that you have designated in your Account to make payments to ANDRO GAMES INFOTECH PVT. LTD. ("Designated Currency"). You may choose your Designated Currency from a list of currencies that we display on the App/Site. You may change your Designated Currency at any time by accessing your Account and using the App/Site Tools. Please be aware that each time you change your Designated Currency, the funds in your Account will automatically be converted into the new currency and we may charge you a currency exchange fee for each such conversion; the amount of the fee is displayed on the App/Site.
21. Intellectual Property Rights.
The content on the App/Site, including without limitation, the text, documents, descriptions, products, technology, software, graphics, photos, sounds, videos, interactive features, and services (collectively, the "Content") and the trademarks, service marks and logos contained therein ("Marks"), are the property of ANDRO GAMES INFOTECH PVT. LTD. and/or its licensors and may be protected by applicable copyright, trademark, patent or other intellectual property laws and treaties. Content may include information about Skills in general ANDRO GAMES INFOTECH PVT. LTD. and the results and prize money in connection with the foregoing, and information regarding the odds of winning a Skill. We reserve all rights not expressly granted in and to the App/Site and the Content. Content on the App/Site is provided to you "AS IS" for your information and personal use only and may not be used, modified, copied, distributed, transmitted, broadcast, displayed, sold, licensed, de-compiled, or otherwise exploited for any other purposes whatsoever without our prior written consent. If you download or print a copy of the Content for personal use, you must retain all copyright and other proprietary notices contained therein. ANDRO GAMES INFOTECH PVT. LTD. and other marks are Marks of the ANDRO GAMES INFOTECH PVT. LTD. or its affiliates. All other trademarks, service marks, and logos used on the App/Site are the trademarks, service marks, or logos of their respective owners.
22. Disclosure.
We reserve the right to access, read, preserve, and disclose any information that we obtain in connection with the App/Site, and your use thereof, as we reasonably believe is necessary to (i) satisfy any applicable law, regulation, legal process, subpoena or governmental request, (ii) enforce the App/Site Terms, including to investigate potential violations of them, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to user support requests, or (v) protect the rights, property or safety of ANDRO GAMES INFOTECH PVT. LTD., its users or the public.

26.1. If you have any questions or complaints regarding the App/Site, including with respect to our Services and/or any payments, you may (i) email us at support@ikltrivia.com, (ii) submit an inquiry to us by using 'Contact Us' option that is provided on the App/Site; (iii) chat with us via the online tool that we provide on the App/Site; and/or (iv) call us (at your own cost) to the support telephone number that we display on the App/Site (collectively, the "Support Service"). We use commercially reasonable efforts to respond as quickly as possible. If you have a complaint, you agree to provide full details of your complaint so that we can clearly identify the issue of concern. We may use the tools, software or services of third-party service providers in connection with the Support Service.
26.2. A complaint must contain clear information regarding the complainant's identity and must include all relevant details which gave rise to the complaint.
26.3. Should you not be satisfied with the way your complaint was resolved or handled you may escalate directly to the Authority by sending an email.
26.4. We will inform you, or the Authority, if the complaint was referred to us by the Authority, by notice in writing, of the results of our inquiry within 21 days from the date on which the complaint was submitted to us.
27 Warranty Disclaimers.
27.1. This section applies whether or not the Services provided under the App/Site is for payment. Applicable law may not allow the exclusion of certain warranties, to that extent certain exclusions set forth herein may not apply.
27.2. THE APP/SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, AND WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESS OR IMPLIED. ANDRO GAMES INFOTECH PVT. LTD. HEREBY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THOSE ARISING BY STATUTE OR FROM A COURSE OF DEALING OR USAGE OF TRADE.
27.3. ANDRO GAMES INFOTECH PVT. LTD. DOES NOT GUARANTEE THAT THE APP/SITE WILL BE FREE OF BUGS, SECURITY BREACHES, OR VIRUS ATTACKS. THE APP/SITE MAY OCCASIONALLY BE UNAVAILABLE FOR ROUTINE MAINTENANCE, UPGRADING, OR OTHER REASONS. YOU AGREE THAT ANDRO GAMES INFOTECH PVT. LTD. WILL NOT BE HELD RESPONSIBLE FOR ANY CONSEQUENCES TO YOU OR ANY THIRD PARTY THAT MAY RESULT FROM TECHNICAL PROBLEMS OF THE INTERNET, SLOW CONNECTIONS, TRAFFIC CONGESTION, OVERLOAD OF OUR OR OTHER SERVERS, DELAY OR FAILURE IN TRANSMISSION, OR ANY ALTERATION OR DISTORTION OF DATA.
27.4. WE DO NOT WARRANT, ENDORSE OR GUARANTEE ANY CONTENT, PRODUCT, OR SERVICE THAT IS FEATURED OR ADVERTISED ON THE APP/SITE BY A THIRD PARTY.
27.5. YOU AGREE THAT ANDRO GAMES INFOTECH PVT. LTD. SHALL NOT BE LIABLE FOR ANY LOSS OR FAILURE TO LODGE A FORM OR PURCHASE CHIPS, OR FOR ANY CLERICAL ERRORS THAT MAY BE INCLUDED IN A SKILL GAME, WHETHER SUCH FAILURE OR ERROR ARISES FROM OUR, OR ONE OF OUR SERVICE PROVIDER'S SYSTEMS, OR OUR, OR ONE OF OUR SERVICE PROVIDERS, HUMAN ERROR (EACH AN "INCIDENT"). TO THE EXTENT THAT ANY INCIDENT ARISES, OR WE BECOME AWARE OF ANY INCIDENT, WE RESERVE THE RIGHT TO CANCEL THAT PARTICULAR SLOT AND OUR SOLE LIABILITY TO YOU, AND YOUR SOLE REMEDY SHALL BE A REFUND OF THE RELATED ORDER PRICE.
27.6 WE DO NOT MAKE ANY REPRESENTATION OR WARRANTY REGARDING YOUR CHANCE OF OBTAINING WINNING NUMBERS OR OF BEING ENTITLED TO A PRIZE.
27.7 EXCEPT AS EXPRESSLY STATED IN OUR PRIVACY POLICY, ANDRO GAMES INFOTECH PVT. LTD. DOES NOT MAKE ANY REPRESENTATIONS, WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE SECURITY OF ANY INFORMATION YOU MAY PROVIDE OR ACTIVITIES YOU ENGAGE IN DURING THE COURSE OF YOUR USE OF THE APP/SITE.
You agree to defend, indemnify and hold harmless ANDRO GAMES INFOTECH PVT. LTD. and our affiliates, and our respective officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs and expenses (including but not limited to attorney's fees) arising from (i) your use of, or inability to use, the App/Site; (ii) any dispute between you and another; or (iii) your violation of the App/Site Terms.
ANDRO GAMES INFOTECH PVT. LTD. encourages a responsible attitude towards skill and gaming, and in this regard, we: (i) prohibit anyone under the age of 18 years (or the applicable age in the relevant country) from registering an Account and using our Services; (ii) recommend that all Users establish limits for participating in ANDRO GAMES INFOTECH PVT. LTD.; and (iii) do not recommend that Users turn to Skill as a source of income or as a way to recoup the debt. If you feel that you are using our Services in an irresponsible way we encourage you to stop using and close your Account by using the App/Site Tools that we make available on the App/Site to do so. These include the following: ANDRO GAMES INFOTECH PVT. LTD. a. You may, at your discretion, choose to limit the amount you may deposit during a specific period as is provided using the App/Site. b. You may, at your discretion, choose to limit the amount you may spend during a specific period as is provided using the App/Site. c. If you wish to reduce a limit or increase an exclusion, these shall become effective immediately upon receipt of notification. If you would wish to increase a limit set by you, such change shall only take place after the request has been received. The time-out and self-exclusion are irrevocable for the selected period.
30. Anti-Money Laundering.
ANDRO GAMES INFOTECH PVT. LTD. will not accept the deposit of any funds which it believes has been obtained by unlawful or ill-gotten means, and will operate checks on all transactions in order to prevent money laundering. Any transactions which ANDRO GAMES INFOTECH PVT. LTD. considers suspicious will be reported to the relevant authorities.
31. Term and Termination.
These Terms are effective until terminated by ANDRO GAMES INFOTECH PVT. LTD. ANDRO GAMES INFOTECH PVT. LTD., in its sole discretion, has the right to terminate your access to the App/Site, or any part thereof, immediately at any time (including, without any limitation, for a breach of the App/Site Terms). ANDRO GAMES INFOTECH PVT. LTD. shall not be liable to you or any third party for termination of the App/Site, or any part thereof. If you object to any term or condition of the App/Site Terms, or any subsequent modifications thereto, or become dissatisfied with the App/Site in any way, your only recourse is to immediately discontinue use of the App/Site. Upon termination of these Terms, you shall cease all use of the App/Site), and any provision which by its nature should survive shall survive termination of these Terms. ANDRO GAMES INFOTECH PVT. LTD.
32. Assignment.
These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you but may be assigned by ANDRO GAMES INFOTECH PVT. LTD. without restriction or notification to you.
33. Mediation and Disputes.
33.1. General. Any claim or dispute arising out of or relating to these Terms and/or your use of the App/Site may be submitted for mediation before the Authority, which can be contacted at the support desk. If such claim or dispute is not resolved by such mediation, it shall be resolved exclusively by arbitration conducted in law, in the English language by a sole arbitrator (“Arbitrator”) appointed by the parties or in the absence of agreement by ANDRO GAMES INFOTECH PVT. LTD. You and ANDRO GAMES INFOTECH PVT. LTD. agree to law as the exclusive forum for resolving any claim or dispute arising out of or related to these Terms and/or your use of the App/Site the Arbitrator will be bound by the provisions of these Terms. Upon rendering a decision, the Arbitrator shall state in writing the basis for the decision, and the written decision of the Arbitrator shall be binding on the parties to the arbitration. Any judgment upon the reward may be entered and enforced in any court of competent jurisdiction. Notwithstanding the foregoing ANDRO GAMES INFOTECH PVT. LTD. may seek injunctive relief in any appropriate court. Each party shall bear its own legal and other costs and expenses in connection with any mediation or arbitration.
33.2. Payment Disputes. If you have a complaint or dispute regarding any payment to us, by us, or under these Terms, including with respect to an Order Price, Prizes, Real Money, or any Bonus Money (a "Payment Dispute") you are first required to submit details of the Payment Dispute to us via our Support Service and we will use commercially reasonable efforts to respond as quickly as possible. Both you and ANDRO GAMES INFOTECH PVT. LTD. hereby agree to cooperate in good faith with each other to amicably resolve the Payment Dispute.
